Acceptable Use Policy
This Acceptable Use Policy ("AUP") sets out the rules of conduct that apply to all users of MortgageNegotiator.ai. It supplements our Terms of Service.
Violating this policy may result in account suspension, account termination, forfeiture of fees, and in some cases referral to law enforcement.
1. Universal Rules — All Users
The following rules apply to every person who accesses or uses the MortgageNegotiator.ai platform, regardless of role.
Misrepresentation and Fraud
- Do not provide false, misleading, or incomplete information when registering or submitting a loan profile.
- Do not impersonate another person or business.
- Do not misrepresent your identity, licensure, financial situation, or eligibility.
- Do not use a false email address or use someone else's email without permission.
Platform Abuse
- Do not submit loan profiles you have no intention of acting on.
- Do not create multiple accounts to manipulate auctions or evade restrictions.
- Do not use bots, scripts, or automated tools to interact with the platform.
- Do not scrape, harvest, or copy data from the platform.
- Do not reverse-engineer or attempt to extract our source code.
Disruption
- Do not interfere with the operation of the Services or other users' use of them.
- Do not attempt to overload, crash, or impair our servers.
- Do not probe, scan, or test vulnerabilities without our explicit written permission.
- Do not circumvent or attempt to circumvent security measures.
Illegal Activity
- Do not use the Services to commit fraud, money laundering, or any other crime.
- Do not violate any federal, state, or local law in your use of the Services.
- Do not infringe any third party's intellectual property, privacy, or other rights.
Harmful Conduct
- Do not harass, threaten, or abuse other users or our staff.
- Do not post or transmit malicious code, viruses, or harmful content.
- Do not spam other users with unsolicited communications.
- Do not engage in discriminatory conduct that violates fair lending or fair housing laws.
2. Buyer-Specific Rules
In addition to the universal rules above, Buyers may not:
- Submit a loan profile for a property you have no intention of purchasing or refinancing.
- Submit a loan profile with falsified credit, income, or down payment information.
- Auction the same loan repeatedly to solicit bids without honest intent to accept.
- Share Broker contact information received from a successful auction with anyone outside your immediate transaction.
- Coordinate with Brokers off-platform to circumvent platform fees after participating in an auction.
3. Broker-Specific Rules
In addition to the universal rules above, Brokers may not:
Bidding Integrity
- Submit a bid you are not prepared to honor.
- Withdraw a bid after the Buyer has accepted — bids are binding.
- Submit collusive bids with other Brokers.
- Submit a bid for a loan you are not licensed to originate.
Buyer Contact
- Attempt to identify Buyers before their auctions close.
- Contact a Buyer whose bid you did not win.
- Use information about Buyers from the platform for any purpose other than the loan you won.
- Add Buyers to marketing lists without their explicit, separate consent.
Licensing and Compliance
- Operate without an active, valid Florida mortgage broker or loan officer license.
- Fail to maintain your NMLS registration in good standing.
- Violate RESPA, TILA, ECOA, the Fair Housing Act, or any applicable lending regulation.
- Discriminate against Buyers on the basis of race, color, religion, national origin, sex, marital status, age, or any other protected characteristic.
Platform Conduct
- Disparage other Brokers on the platform.
- Coordinate with other Brokers to manipulate bidding.
- Use the platform to recruit other Brokers' staff or solicit other Brokers' business.
- Use confidential platform data for any competitive purpose.
4. Realtor-Specific Rules
In addition to the universal rules above, Realtors may not:
- Misrepresent the platform to Buyers, including overstating outcomes or guarantees.
- Receive or offer kickbacks for referrals — the platform does not pay referral fees.
- Pressure Buyers to use a specific Broker on the platform.
- Use the platform's data about Buyers for purposes outside the referral.
- Violate RESPA, your state's real estate laws, or your brokerage's policies regarding referrals.
- Misrepresent your real estate license status.
5. Reporting Violations
If you become aware of a violation of this policy, please report it to:

- Subject line: "AUP Violation Report"
Include as much detail as possible. We investigate all reports and may take action including warning the user, suspending or terminating their account, forfeiting paid fees, reporting illegal activity to authorities, or notifying NMLS or state regulators for Broker violations.
6. Enforcement
Our enforcement actions are at our sole discretion. We may act without prior notice when the violation is severe or harmful, there is risk of ongoing harm, or legal or regulatory considerations require immediate action.
For less serious violations, we typically issue a warning explaining the issue, give the user an opportunity to correct the behavior, and escalate to suspension or termination if the behavior continues. We reserve the right to act differently based on the specific circumstances of each case.
7. Changes to This Policy
We may update this AUP from time to time. We will notify users of material changes and post the updated policy on the website.
