Realtor Referral Terms

These Realtor Referral Terms ("Terms") govern participation by licensed Florida real estate agents ("Realtors," "you," or "your") on the MortgageNegotiator.ai platform, operated by Mortgage Negotiator LLC ("MortgageNegotiator," "we," "us," or "our").

By registering as a Realtor on the Platform, you agree to these Terms. These Terms supplement our Terms of Service, Privacy Policy, and Acceptable Use Policy.

1. What This Is

MortgageNegotiator.ai is a mortgage auction platform. Buyers submit loan profiles and licensed Florida mortgage brokers compete to offer the best rates and fees. Realtors can refer their buyer clients to the platform using a personalized referral link.

This is not a referral fee arrangement. You receive no compensation — monetary or otherwise — from MortgageNegotiator for referring Buyers. Your participation is entirely voluntary and is offered as a value-added service for your clients.

2. How Referrals Work

  1. You register as a Realtor on the Platform and receive a personalized referral link.
  2. You share your referral link with buyer clients who are seeking a mortgage.
  3. When a Buyer signs up through your link, our system associates that Buyer's account with your referral for tracking purposes only.
  4. Your referral dashboard shows aggregate, anonymized outcomes — not individual Buyer data.
  5. No money flows between you and MortgageNegotiator in connection with referrals.

3. RESPA Compliance

No compensation of any kind is paid or received in connection with referrals. This program is structured to comply with RESPA Section 8.

The Real Estate Settlement Procedures Act (RESPA) Section 8 prohibits giving or accepting any fee, kickback, or thing of value pursuant to any agreement or understanding for the referral of mortgage settlement service business. To maintain full compliance:

  • We do not pay you for referrals.
  • You do not pay us.
  • We do not require referrals from you to maintain platform access.
  • We do not track or reward referral volume in a way that constitutes "value."
  • We do not facilitate kickbacks from Brokers to Realtors via the Platform.

If you have questions about whether your participation complies with RESPA, consult with your broker, compliance officer, or legal counsel before participating.

4. Eligibility

To participate as a Realtor, you must:

  • Hold an active Florida real estate license.
  • Be in good standing with your real estate brokerage.
  • Have authority to share marketing tools with your buyers under your brokerage's policies.

You acknowledge that some brokerages have policies governing the use of third-party tools and referral programs, and that it is your responsibility to confirm participation is permitted under your brokerage's rules. We are not responsible for any disputes between you and your brokerage.

5. What You Receive

Referral Link

You receive a personalized referral link tied to your account. When a Buyer signs up through your link, our system associates that Buyer's account with your referral.

Referral Tracking Dashboard

Your dashboard shows aggregate data only:

  • Number of clicks on your link
  • Number of Buyers who submitted loan profiles
  • Number of Buyers who completed auctions
  • Number of Buyers who accepted bids (aggregate; no Buyer personal details)
  • Aggregate savings achieved by your referred Buyers (anonymized)

Optional Co-Branding

We may offer co-branded landing pages including your name, photo, and brokerage. You are responsible for ensuring co-branding complies with your brokerage's policies, Florida real estate advertising rules, and fair housing requirements.

6. Communications with Buyers

When referring Buyers to the platform, you agree to:

  • Be honest about the Platform's services and pricing.
  • Not guarantee specific savings or outcomes.
  • Not represent that you receive compensation for the referral.
  • Not represent the Platform as having properties or services it does not offer.

We provide sample referral pitch language as a starting point. Your communications with Buyers are your responsibility. We disclaim responsibility for representations you make that differ from our published materials.

7. Data You Receive About Buyers

The data in your referral dashboard is aggregate and anonymized. You do not receive Buyer names, contact information, or addresses; specific loan amounts, credit scores, or financial details; information about which Broker won a Buyer's auction; or any information you could use to identify a specific referred Buyer.

We provide aggregate outcome data only for the purpose of helping you understand whether your referrals are succeeding on the Platform — not for use in real estate transactions.

8. Termination

By You

You may terminate your Realtor account at any time by emailing support@mortgagenegotiator.ai.

By Us

We may terminate your participation, immediately and without notice, for:

  • Violation of these Terms or our Acceptable Use Policy
  • Loss of your real estate license
  • Receiving compensation from any party in connection with a referral
  • Misrepresentation of the Platform or its services
  • Pattern of complaints from referred Buyers
  • Any conduct that risks the Platform's RESPA compliance

9. No Implied Endorsement

Your participation does not imply that MortgageNegotiator endorses you, your brokerage, or any specific property. Co-branded landing pages do not imply that you are MortgageNegotiator's employee, partner, agent, or representative. You may not represent yourself as a MortgageNegotiator employee, agent, or partner.

10. Indemnification

You agree to indemnify and hold harmless MortgageNegotiator from any claims, damages, or expenses arising from your representations to Buyers about the Platform, your violation of these Terms or applicable law, or your real estate activities, which are entirely independent of the Platform.

11. Governing Law

These Terms are governed by Florida law. Disputes are resolved as set forth in the MortgageNegotiator Terms of Service.

12. Changes

We may update these Terms on 30 days' notice. Your continued participation constitutes acceptance of the updated Terms.
